- Article 41. Rights of Patients
A patient shall have the right to:
- receipt of medical care;
- choice of attending physician and healthcare organization;
- participation in the choice of methods for providing medical care;
- stay in a healthcare organization under conditions that meet sanitary and epidemiological requirements and allow for the realization of the right to safety and protection of personal dignity;
- respectful and humane attitude from healthcare workers;
- receipt of information in an accessible form about their own health status, the applied methods of providing medical care, as well as about the qualifications of the attending physician, other medical workers directly involved in providing them with medical care;
- refusal to enter information constituting medical confidentiality into the centralized healthcare information system, except for information provided by healthcare organizations to law enforcement agencies in accordance with the second paragraph of part eleven of Article 46 of this Law;
- familiarization with medical documents available in the healthcare organization and reflecting information about their health status, facts of seeking medical care;
- choice of persons to whom information about their health status may be communicated;
- refusal of medical care, including medical intervention, except for cases provided for by this Law;
- alleviation of pain associated with the disease and (or) medical intervention by all methods of providing medical care, taking into account the treatment and diagnostic capabilities of the healthcare organization;
- realization of other rights in accordance with this Law and other legislative acts.
When receiving medical care in inpatient conditions, a patient shall have the right to admit a clergyman, as well as to be provided with conditions for performing religious rites, if this does not violate the internal regulations for patients, sanitary and epidemiological requirements.
Granting the patient the rights specified in this article shall not be carried out to the detriment of the health of other patients and shall not violate their rights and freedoms.
- Article 42. Duties of Patients
A patient shall be obliged to:
- care for their own health, take timely measures to preserve, strengthen and restore it;
- treat healthcare workers and other patients respectfully;
- follow the recommendations of medical workers necessary for implementing the chosen treatment tactics, cooperate with medical workers when receiving medical care;
- inform medical workers about the presence of diseases that pose a danger to public health, the human immunodeficiency virus, as well as observe precautions when in contact with other persons;
- inform medical workers about previously identified medical contraindications to the use of medicines, hereditary and past diseases, about seeking medical care, as well as about changes in health status;
- observe the internal regulations for patients, handle the property of the healthcare organization with care;
- fulfill other duties provided for by this Law and other legislative acts.
